Zuyd Group is a partnership between the legal entities affiliated to Zuyd Group. The legal entities have a partnership but independently conclude agreements with third parties or clients. They handle cases independently, in their own capacity and for their own account and risk by virtue of their legal entity.

Controller

Zuyd Group is the so-called data controller within the meaning of the General Data Protection Regulation (AVG). This means that Zuyd Group decides which personal data is processed, for what purpose and in what way. Zuyd Bailiffs is responsible for ensuring that your personal data is processed in accordance with the AVG and in a proper and careful manner.

What do we collect and why?

Personal data

Personal data is any data that can provide information about an identifiable natural person.

Zuyd Group processes a lot of personal data, including regularly some special personal data. In addition to legislation from the AVG, Zuyd Group also has to deal with legislation that applies specifically to bailiffs and administrators.

From whom do we collect data?

We collect and use personal data. This may be from you or from you and your partner if, for example, there is joint debt. If you are represented by another person, for example a trustee, debt relief worker or lawyer, we also collect a limited amount of (contact) data from this person.

Of a minor in debt, we also collect and use the data of the parent(s) or guardian.

Camera surveillance

We have camera surveillance for your and our safety. Where this is the case, this is indicated. These images are deleted after 72 hours.

Processing purposes

The processing of personal data by the judicial officer is carried out for the purposes of:

  • the performance of official duties as referred to in Article 2(1) of the Bailiffs Act;
  • the performance of non-official activities as referred to in Article 22(1) of the Bailiffs Act.

Categories of data

The processing of personal data may involve:

  • name, address, PO box number, postal code, place of residence, date of birth, sex, marital status, titles, telephone number, fax number, e-mail address;
  • BRP number, BSN and other identified data;
  • data on income, assets and debts;
  • data relating to past or current actions or transactions in matters that may affect or result from the tasks and work assigned by or under the law or by the client;
  • details of the amounts received from the other party in those matters and costs recoverable from him;
  • other non-categorisable data necessary for the purpose of processing.

Basis of processing

Zuyd Bailiffs must be able to base the processing of your personal data on one of the bases in the AVG.

Most of the processing is done from:

  • the necessity for the performance of a contract to which the data subject is a party;
  • the legal obligations from, among others, the Bailiffs Act;
  • processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority;
  • the legitimate interest of the principal and the judicial officer.

With which external parties do we share your data?

If necessary for the performance of official and non-official activities, we share your data with external parties. This may include, for example, our client, judicial authorities, public and closed registers, the source of income, locksmiths, other bailiffs and the digital seizure register, but only insofar as necessary for the performance of the tasks and activities assigned by or pursuant to the law.

Data is occasionally provided by Zuyd Group to an authority in a third country if international treaties require it.

Provision of data will not take place if this would violate Zuyd Group's duty of confidentiality.

Here, too, Zuyd Group is guided by the Code of Conduct for Bailiffs and/or Administrators for the Protection of Personal Data.

Where are personal data stored by Zuyd Group?

To process personal data, Zuyd Group works with an automation system where personal data is stored within the EEA.

Personal data security

Zuyd Group is obliged, by taking appropriate technical or organisational measures, to process personal data in such a way as to ensure its appropriate security, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage (integrity and confidentiality).

Retention period personal data

Zuyd Group stores your personal data no longer than necessary for the purpose of processing.

If necessary, Zuyd Group may decide to retain documents and/or data for a longer period of time.

Do you want to modify something or have a question?

Zuyd Group strives to process data correctly in its systems. Should you nevertheless notice that your data has not been processed correctly, please let us know. You are entitled, for example, to inspect or correct your data.

Your privacy rights

You have the right to access your personal data, object to the use of your data and the right to request correction or deletion of your personal data. If you want to know what personal data Zuyd Group processes about you, you can make a written request for inspection. Zuyd Group will process your request within one month of receiving it.

Does it turn out that your data is incorrect, incomplete or irrelevant? Then you can make an additional request to have your data changed or supplemented. Zuyd Group does have to start from the official registers when doing so. For example, if you want your address changed, you must first change it in your municipality's Personal Records Database.

How can you file a complaint?

In addition, the data subject has the right to lodge a complaint with the supervisory Authority for Personal Data. This can be done, for example, if we collect data from you and you are dissatisfied with this privacy notice or the way we handle your data.

Mandatory data breach notification and other requirements under the AVG

The AVG requires any data breaches to be reported to the Personal Data Authority by the data controller. Zuyd Bailiffs, as the data controller, will report to the Personal Data Authority.

Careful handling of personal data and compliance with the AVG is part of our daily policy. In addition to a data breach protocol, Zuyd Bailiffs has also drawn up a register for processing activities, there is a policy for doing a Privacy Impact Analysis (PIA), processing agreements are concluded and our employees are trained with regard to information security awareness.

Frequently asked questions

How do I get in touch with Zuyd Group?
Zuyd Group has several contact options. We understand that you do not always want or are unable to contact us by phone, which is why you can chat, email, whatsap or video call us. A personal visit to our office is unfortunately not possible due to corona; video calling may be an option for you.
I have sent an e-mail/letter, but still no reply?
We aim to reply to your e-mail/letter within three working days. We may need to request information from our client, which may take longer to respond. Of course, you can always call us (from the 4th working day onwards) to ask why you have not yet received a response. Is it urgent? Then call us as soon as possible.
I receive mail at my address for a person who does not live here (anymore). What can I do?
In this case, we ask that you return the mail to us unopened so that we know the address is incorrect.
How do I file a complaint?
If you are dissatisfied with Zuyd Group's work as an organisation or the work of an employee, you can submit your complaint using a complaint form.
On which days is Zuyd Group closed?
